A new sentencing code for England and Wales : transition : final report and recommendations

The aim of the current project was to consider the codification of the law governing sentencing procedure, understood as the process applicable from verdict to the end of the sentence imposed and to design a sentencing procedure Code, embodied in one Act with a clear framework and accessible drafting. Such a new Code would provide the courts with a single point of reference, capable of accommodating amendment and adapting to changing needs without losing structural clarity. On 1 July 2015 the Commission published an issues paper seeking views on an aspect of the project to codify sentencing procedure in the New Sentencing Code. This report summarises the responses received to that consultation, and lists the recommendations made in light of those responses. The recommendations include that: a court sentencing under the Code (and an appellate court on appeal) should ask whether the total penalty which it is considering imposing for the offence(s) before it, taken as a whole, would be more severe than the maximum which could have been imposed for the offence(s) at the time of commission; new laws on prescribed minimum sentencing and recidivist premiums be applied only to cases where the index offence post-dates the change in the law; the New Sentencing Code and later versions of it should apply to all sentencing exercises in which conviction takes place after commencement of the Code or that version of it. The Commission also sets out in a little more detail some of the practical implications of the approach that they recommend.… (más)
