While it has been over 50 years since publication, The Trial of the Germans is not dated. It contains biographical sketches of the 22 most notable major Nazis put on trial at Nuremburg. Divided into sections, it apportions equal time to those defendants that represented the party, the diplomatic corps, the police and army, the navy, the justice system, and business. Davidson, of course, not only provides biographies and background context, he also describes the process of the trials and an assessment of their validity and fairness. His last few sentences are revealing of the insight the book yields:

One red thread runs through the trial and binds in a curious way both the victors and the vanquished. It is the power exerted by an ideology. The power was manifested in those on the German side who accepted the fixed ideas of their society, in their Russian opposite members who could cooly accuse the Germans of a crime they knew the defendants had not committed (the Katyn massacre), in the American and British who could swallow almost any legal nostrum as long as it made them see a postwar society of their imagining. Small things were rescued at Nuremburg (although they meant in some cases the difference between life and death), such as the unspoken principle that no one be convicted of the same crime the Allies conceded their side had committed, that no one be hanged for the crime of having waged or plotted to wage war. For the deeper answers we must look to history and its meaning for ourselves.

Il processo di Norimberga ha rappresentato la migliore risposta ai crimini del Terzo Reich? Si è trattato veramente di un processo equo, considerato che gli imputati si sono difesi affermando che nel compiere le orribili nefandezze di cui sono stati accusati stavano servendo il proprio paese ed eseguendo ciò che era stato loro ordinato di fare? E se non giusto, è stato ciò nonostante un monito necessario per prevenire crimini
futuri contro l'umanità? Come mai i tedeschi e la Germania si sono resi responsabili di tante atrocità? Eugene Davidson ha cercato di rispondere a queste e a moltissime altre domande esaminando con attenzione ogni singolo caso, ognuno dei ventidue imputati. Il suo è considerato lo studio definitivo e più completo sul processo di Norimberga pubblicato in volume. La sua conclusione, riluttante ma al tempo stesso ferma, è che «in un mondo
di complesse relazioni umane in cui viene fatta una giustizia sommaria comunque preferibile al linciaggio o alla fucilazione, il processo di Norimberga dovrebbe essere difeso in quanto evento politico se non come tribunale», Alcune sentenze sono sembrate troppo severe, ma nessuna è stata certo più dura delle pene inflitte a persone innocenti dal regime che gli imputati servivano.
«In un certo senso», sostiene Davidson, «il processo è riuscito a fare ciò che si suppone ogni azione legale debba fare: ha cioè convinto perfino il colpevole che il verdetto contro di lui era giusto». Dal punto di vista legale le decisioni prese dal tribunale militare internazionale di Norimberga -che coinvolgevano emotivamente milioni di persone -non sono certo ineccepibili, ma rappresentano comunque il primo tentativo di mettere sotto accusa
chi, forte del proprio potere, si è macchiato di crimini contro l'umanità, nonché una testimonianza storica di enorme portata, da preservare debitamente per le generazioni future.… (más)
